How compounds are classified in Austria

Governing law and regulatorAustria applies EU medicines law through the Arzneimittelgesetz (AMG). The Bundesamt fuer Sicherheit im Gesundheitswesen (BASG), operating under AGES, is the competent authority for licensing, market surveillance and enforcement of human medicines, including online and imported products.
Research-label positionBASG has published a dedicated statement holding that a research-use, research-grade or laboratory-only label on a peptide is legally irrelevant. Products are classified by BASG as unlicensed medicines based on active ingredient, concentration, effect and available scientific data, not by seller-supplied packaging language.
Import and marketing banOnce BASG classifies a peptide as an unlicensed medicine, placing it on the market in Austria and importing it into Austria are both prohibited. Legal consequences fall on distributors and importers, and BASG explicitly warns that buyers themselves can also face consequences such as referral to authorities.
GLP-1 classIn a notice dated 4 September 2025 citing a joint EMA/HMA warning, BASG confirmed GLP-1 receptor agonists such as semaglutide, liraglutide and tirzepatide are prescription-only medicines for obesity and diabetes. Online sale of prescription medicines is banned in Austria, and fake listings misuse the BASG logo.
Prescription compounds and wholesale routeSomatropin and hCG/HMG-class gonadotropins appear as registered prescription medicines in Austria's own medicines database. Legal wholesale import and resale requires a Grosshandelsbetriebsbewilligung under section 63 AMG, issued by BASG and listed on its public register of authorised wholesale businesses.

  • Hold a Grosshandelsbetriebsbewilligung (section 63 AMG wholesale licence) from BASG before importing or reselling any of these compounds.
  • Do not rely on a research-use or research-grade label; BASG regards that framing as legally irrelevant and classifies the product as an unlicensed medicine on ingredient and effect.
  • Assume GLP-1, somatropin, gonadotropin and Melanotan-class peptides is prescription medicines; online sale of prescription medicines is banned outright in Austria.
  • Expect enforcement contact through BASG's enforcement@basg.gv.at channel; both importers and buyers of unlicensed peptides face legal exposure.
